Terms and conditions

1a) The promoter is Highland holiday giveaways ltd, the company number is SC787626 and its registered office is at 6 Dunnett avenue, Wick, Caithness, Scotland KW1 4DY

The competitions

2a) These terms and conditions (T&C’s) apply to competitions listed on the promoters webpage www.highlandholidaygiveaways.co.uk

2b) All draws ran by the promoter on its website to win prizes shall be referred to as competition or competitions. This is for on off prize competitions as well as instant win add on prizes (instant win prize)

2c) All competitions include a competition question and an entry fee is payable each time you enter a competition. Where the promoter offers a multiple choice or easy question. There shall also be a free entry route available.

 

Eligibility

3a) Competitions are open to all persons aged 18 or over who currently have a UK or Ireland address.

3b) By entering the competition, the entrant will be deemed to

  • Read and understand all terms and conditions
  • Have the legal capacity to enter the competition
  • Be bound by them and any other requirements stated on the promoters website.

3c) The promoter reserves the right to refuse a customers entry at its own discretion

3d) any disputes unsettled will be dealt with in Scottish courts

3e) No competitions shall be entered by any of the employees of the promoter, also none of there immediate family shall be able to enter. No agents used in any of the prizes shall be allowed to enter either

3f) The promoter shall not accept any entries into the competition that are generated by a computer or incomplete

3g) No refunds to the competition shall be given in the event;

  • If following your entry into the competition you find out you are now ineligible
  • If you are disqualified by the promoter for any reason
  • If the entrants engage in any form of fraud, fraudulent misrepresentation, fraudulent concealment, hacking or interference with the website, manipulating the website coding
  • If any of the above, entries shall be declared void and access to future competitions may be cancelled

How to play

4a) The competition will run from and include the opening and closing dates specified on the website. These dates will be referred too as the “opening date” and “closing date”. All times in the competition shall be GMT dates and time in London, England.

4b) If it is necessary, the promoter retains the right to change the opening date and closing date. If the promoter decides to do this then the new date and time of the competition shall be displayed on the promoters website.

4c) all competition entries must be received by the promoter by no later than the specified time on the closing date. All competition entries received after the closing date time specified on the website shall be automatically disqualified and no refund will be given

4d) The maximum number of entries to a competition will be stated on the website. The number of entries you are able to make may be limited if the maximum number of entries are reached.

4e) entries including free entries are limited per person in the competition. The maximum amount of entries for each entrant for a competition will be listed on the webpage for the relevant competition on the website. If the maximum amount of entries are reached then no further entries shall be allowed.

4f) to enter a standard competition or instant win competition using the paid entry route, go to the website and view the standard competition you wish to enter,

  1. Input your answer to the competition
  2. Select the required number of entries and proceed to checkout
  3. Log in or register if you don’t already have an account
  4. Agree to the T&C and complete purchase

4g) If using PayPal or apple pay please refer to there own terms and conditions for payment

4h) when purchasing an entry online, the promoter will send a confirmation email to the entrant confirming that the entry has been received

4i) the promoter takes no responsibility for competition entries that are not completed successfully, are lost or are delayed regardless of how its caused.

4j) By purchasing entries and/or submitting a competition entry (either purchased online or submitted as a free entry) you are confirming you are eligible to enter the competition; you also willingly acknowledge you are entering into a contract with the promoter; and you agree to be bound by these T&C’s

4k) You may enter any of the competitions listed on the promoters website for free by complying with the following conditions.

  1. Send your entry by pre paid first or second class post to the promoter at the following address: 6 Dunnett avenue, Wick, Caithness, KW14DY
  2. Hand delivered entries shall not be accepted and wont be placed in any draw
  3. Include with your entry the following information
  • Details of the competition you would like to enter
  • Your full name
  • Your Date of birth
  • Your Postal address
  • Your contact telephone number and email address
  • Answer to any competition questions
  1. Incomplete or ineligible entries shall be disqualified
  2. You may make multiple entries for any competition up to any limit placed on entries by the promoter (this amount shall be displayed on the promoters website for each competition individually) however each free entry must be submitted and posted to the promoter separately. If more than one entry is received in the one delivery it shall only count as one. All entries must also be delivered by a courier and no hand delivered entries shall be counted.
  3. Your entry into a standard competition must be received by the promoter prior to the closing date and prior to all tickets in a competition being allocated, free entries received within 48 hours of the closing date shall not be entered but at the promoters discretion it may be entered into another upcoming competition of a similar value.
  4. Your free entry into an instant win competition must be received before all tickets have been sold/allocated and not within 48 hours of the competition closing or this shall also not be counted
  5. If the number of entries received reaches the limit before your free entry is received you will not be entered into the competition.
  6. Entrants must have an account on the website for a free entry to be counted and processed. All details must match the account details

Choosing a winner

5a) Unless stated in competitions, all entrants who correctly answer the competition question will be placed into a draw and an entrant will be chosen by a random number generator whilst being streamed live to protect integrity. The random draw will take place as soon as possible and maximum time 7 days after the closing date of the competition. This will be advertised.

5b) All standard competition entrants will have their names and entry numbers included on a spreadsheet which may be seen on the website. If for any reason entrants do not want there name to be seen on this then they should get in touch with the promoter at info@highlandholidaygiveaways.co.uk

5c) For instant win competitions, Prizes shall be allocated at random to numbers within the spreadsheet before the draw has taken place. Each entry into the competition which correctly answers the competition question is then given a randomly generated number. If this matches the instant win number then the entrant wins the prize.

5d) Entrants who pay for there entry online will be notified if they have won after the purchase of their ticket and if so which prize they have won.

5e) Free entries into the instant win competition, as long as valid and accepted by the promoter, shall be randomly allocated a number. The promoter shall notify the entrant if they are successful by an email sent to the entrants email provided. Unsuccessful entrants who use the free entry route shall not be notified.

The prize

6a) The prize for each competition is described on the website “the prize”. Details of the prize are to the best of the promoters knowledge, correct and as described on the website as at the opening date

6b) Prizes are subject to availability. The promoter reserves the right to substitute the prize with one of either equal of greater value. If any details of the prize change, the promoter shall update the website at the earliest opportunity. For instant win prizes stated on the website, these are available to be won. There is no guarantee that these shall be won, this shall depend on the amount of tickets sold for each competition. If all tickets are sold the instant win prize is guaranteed to be won

6c) The promoter takes reasonable steps to award the prize as described in the website. The promoter makes no other representation and gives no warranty about the prize, its value or condition or any other information provided on the website. The promoter makes no representation and gives no warranty that the information on the website is accurate, complete or up to date.

6d) There is no cash alternative for the prize unless stated on the website. The promoter reserves the right to provide one if the winner would rather but shall do this in its sole discretion.

6e) The prize is not refundable, negotiable, or transferable

6f) if the prize is a holiday or event

  1. The prize description will specify the number of tickets included, by what class of transport and which type of carrier and to which travel destination. Some prizes may have flexibility on dates but this shall be at the discretion of the promoter. For events such as concerts or sports games etc, the dates are non negotiable
  2. The prizes does not include travel insurance or the cost of transport to and from the airport from entrants home address, food and drink, spending money, tax or personal expenses or any other items not stated to be included as a prize on the website. Any other costs not stated within the website prize shall be the responsibility of the winner.
  3. If a cash prize is also stated on the website however this is the extent of responsibility from the promoter
  4. The winner of the prize shall be responsible for ensuring all travel documents are in place such as passports and visas for themselves and anyone travelling with them, once dates are notified to the travel agents they cannot be changed

Winners

7a) The decision of the promoter is final and no discussions or correspondence shall be entered into

7b) For standard competitions, the promoter will contact the winner personally as soon as possible after the draw date, using either the telephone or email address provided with the competition entry. This shall be no later than 7 days after the draw date

7c) If the winner cannot be contacted within 14 days of the draw date then the promoter reserves the right to offer the prize to another entrant using the same method and using the correct entries made before the closing date

7d) For instant win competition, Entrants via the paid for route online will find out online if they have won or not. For entrants made through the free postal route, the promoter shall get in contact with them personally using the contact information provided with there entry. If the winner cannot be contacted within 14 days of the promoters first attempt to contact them then the promoter reserves the right to allocate a new number to the prize and add the prize back to the prize pool for that competition or dispose of the prize as t sees fit without any liability of the winner

7e) The promoter must either publish or make available the information of the winner to show that a valid award has taken place. To comply with this the promoter shall publish the name and winning number of each competition on the website

7f) If you object to your name or details being posted on the website then please contact the promoter at  info@highlandholidaygiveaways.co.uk before the closing date. In such circumstances, the promoter must still provide the information to the advertising standards authority on request.

7g) The promoter reserves the right to forfeit a prize where it reasonably suspects that a winner is not eligible or has not complied with the T&C’s. In this circumstance it may dispose of the prize as it sees fit and in its sole discretion.

8a) All prizes won must be collected in person. Nobody else can claim any prize on the winners behalf. Prizes shall either be hand delivered or emailed to the mail provided when purchasing a ticket.

8b) Any cash prizes shall be transferred to a bank account selected by the winner. The winner must provide evidence of whether it is a sole or shared bank account. Failure to do this within 14 days will result in disqualification from the competition and any prizes won shall be forfeited. In this circumstance the promoter reserves the right to award the prize to the next eligible entrant selected from the entries that played the competition, or If it was an instant win competition prize then dispose of it as the promoter sees fit with no liability for the winner

8c) If personal details, including contact information changes at any point then the promoter should be made aware as soon as possible. These notifications should be sent too info@highlandholidaygiveaways.co.uk.  These notifications should include the competition that has been entered, your old details and your new details. The promoter shall then use whichever details is best to contact you

8d) The promoter doesn’t accept any responsibility and is not liable to pay any compensation if a winner is unable to or does not take the prize

8e) The promoter reserves the right not to award any prize if the prize is not claimed by the winner in accordance with these T&C’s

Limitation of liability

9a) To the extent as is permitted by law, the promoter, its agents or distributors shall not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize, unless if it is caused by negligence from the promoter or its employees. Your statutory rights are not affected

9b) The promoter shall not be liable for;

  1. Any entries that are not received due to incorrect or inaccurate entry information, faulty or failed data transmissions or any other reasons.
  2. Unauthorized access to, theft, destruction or alterations to entries at any point
  3. Inaccessibility or unavailability of networks, lines, satellites, servers, computers or providers used in any aspect of operation of a competition
  4. Technical malfunctions and errors from the entrant
  5. The winners use of the draw

Data protection and publicity

 

10a) By entering a Competition, you agree that any personal information provided by you with the Competition entry may be held and used only by the Promoter or its agents and suppliers to administer the Competition or as otherwise set out in the Promoter’s Privacy Policy , a copy of which is available on the Website

10b). If you are the Winner of a Competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of the Competition. You further agree to participate in any reasonable publicity required by the Promoter

 10c) If a Winner does not wish to participate in any publicity, it must notify the Promoter prior to the Closing Date. This will not affect your chances of winning the Prize. If you do not agree to participate in any publicity about the Competition we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the Competition has been properly administered and the Prize awarded

10d) If you are the Winner of a Competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the Competition and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Promoter reserves the right to offer the Prize from a Standard Competition to the next eligible Entrant selected from the correct entries that were received before the Closing Date. The Promoter reserves the right dispose of the Prize from a Instant Win Competition as it sees fit without any liability to the Winner for having done so

10e) Please note that under data protection laws you are entitled to request that the promoter does not contact you and takes your details from its database. If you wish for this the you can request it by contacting on info@highlandholidaygiveaways.co.uk prior to the closing date. If you make this request then you shall be forfeited from any competition entered as it will not be possible to contact you in the event that you are a winner

General

 

11a) The promoter reserves the right to update these terms and conditions as required. All updated versions shall be available on the website.

11b) If the promoter believes that anyone has breached the terms and conditions then it reserves the right to exclude the entrant from participation in any competitions.

11c) The promoter reserves the right to hold, suspend, void, amend or cancel the competition where situations of its control occur. In this case all entrants will be refunded that have paid

11d) There is not a minimum amount of entries on a competition. The promoter will not void, suspend or cancel the competition due to lack of entries, regardless of the amount.

11e) The competitions on the website are in no way associated with any of the social media platforms used to advertise on. Facebook, Instagram and Tiktok have no liability or responsibility for any promotion or administration of the competitions

11f) The terms and conditions are governed by Scottish law

11g) You may and should print a copy of the T&C’s before entering and keep them
